Terms and Conditions

These Terms and Conditions (“Agreement”) govern the use of www.missdailyassistant.com (the “Site”) and the services provided by Miss Daily Assistant (“Service Provider”). By using this Site, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use this Site.

1. Services Provided

Miss Daily Assistant provides personal assistant services to clients, which will be discussed and agreed upon during a consultation and outlined in the signed agreement. The scope of work may be adjusted as needed with mutual agreement from both parties.

2. Payment Terms

  • Payments are due within 7 days of the invoice date.

  • Services will not begin until payment is received, with options for full payment or 50% upfront payment.

  • For upfront payment, the remaining balance is due upon completion of the services, with an additional $100 fee added to the balance.

  • If the client opts for upfront payment, it must be requested at least 7 days before services begin.

  • If the full payment option is selected, the entire invoice is due before services begin.

  • Late payments may incur a 5% late fee for every 5 days the payment is overdue.

3. Client Responsibilities

  • The Client is responsible for providing all necessary materials, information, and documents required for service completion.

  • The Client agrees to provide prompt feedback and respond to requests for additional information or approvals.

  • Timely payments are the responsibility of the Client as outlined in this Agreement.

4. Service Provider Responsibilities

  • The Service Provider agrees to complete the services within the agreed-upon scope and timeline.

  • Regular communication will be maintained to provide updates and address any concerns.

  • The Service Provider will be available for check-ins during regular work hours.

5. Cancellation & Rollover Policy

  • No Refunds: No refunds will be issued for services paid upfront.

  • Rollover of Unused Hours: If services are canceled, unused hours may roll over to a future billing cycle, provided the Client gives at least 7 days’ written notice.

  • Rollover Hours Limitations:

    • Rollover hours must be used within 30 days.

    • Rollover hours cannot exceed the original number of hours in the Client’s current package.

    • Rollover hours are not applicable to one-time project-based services or VIP Days.

    • Unused rollover hours expire after 30 days.

6. Dispute Resolution

  • Both parties agree to resolve disputes through informal discussions initially.

  • If informal resolution fails, both parties agree to engage in mediation with a neutral third-party mediator. Mediation costs will be split equally between both parties.

  • If mediation fails, the dispute will be resolved through arbitration in accordance with the laws of Alabama.

7. Confidentiality

Both parties agree to maintain confidentiality and not disclose sensitive information to third parties without written consent, except as required by law.

8. Limitation of Liability

The Service Provider’s liability is limited to the amount paid by the Client for the specific service rendered. The Service Provider is not responsible for any indirect, incidental, or consequential damages arising from the services provided.

9. Termination

Either party may terminate this agreement by providing written notice. In the event of termination, the Client will be responsible for payment for any completed work.

10. Applicable Law

These Terms and Conditions are governed by the laws of the State of Alabama.

11. Severability

If any part of these Terms and Conditions is found to be invalid or unenforceable under applicable law, the remaining provisions will remain in full effect.

12. Changes to Terms

These Terms and Conditions may be updated at any time to reflect changes in law or business practices. Clients will be notified of significant changes, and the “Last Updated” date will be adjusted accordingly.
